The Ministry of Labour, War Invalids and Social Affairs (MOLISA) has circulated a number of draft decrees guiding the new Labour Code and the new Law on Trade Unions as listed below

In accordance with Vietnam’s commitments to transparency and consultations made in the  Bilateral Trade Agreement, in the report of the Working Party on the Accession of Vietnam to the WTO, and as ratified by the National Assembly in Resolution No. 71, Nov 29, 2006, MOLISA and VCCI proposed this workshop and dialogue meetings with MOLISA’s Legal Department Director, Mr. Dang Duc San.

AmCham agreed to organize this event in cooperation with two of the three legs of the Tri-Partite Partnership (MOLISA and VCCI, representing the Government and the Employers), and interested Foreign Business Associations.

Mr.  Đặng Đức San was named Director of the MOLISA Legal Department in January 2008. The Legal Department’s responsibilities include drafting laws and regulations, systemizing the legal framework, reviewing the proposed laws and regulations of other ministries, agencies, People’s Councils, and People’ Committees’ regulations relating to labour, outreach and education regarding labour laws and regulations, etc. After an unprecedented wave of work stoppages in Vietnam in 2008, mostly in FDI factories, and mostly in the Southern Key Economic Region, Mr. San played an instrumental role in the preparation of the revised Labour Code over the period 2008 – 2012 to implement the Prime Minister’s Decision 1129/QD-TTg, 18 Aug 08, “Action Plan for the Implementation of Directive No. 22-CT/CW, 5 Jun 2008 of the Secretariat of the Party Central Committee to establish a framework for enhancing leadership, providing direction for the development of harmonious, stable and progressive labor relations within enterprises.”
