AmCham HR Committee welcomes you to its first event in 2016: “Employment and Labor Law Update – What’s New for 2016?” Experts from Baker & McKenzie and Santa Fe will present updates to labour legislation over the last year, and provide a special focus session on the expatriate mobility to Vietnam especially with new Decree No. 11, coming into effect on 1 April 2016.

The last year has introduced significant changes to Vietnam’s labour laws, which will impact how business is conducted in Vietnam.  Recent legislative changes have resulted in increased costs to employers, such as the increased regional and general minimum wages, the changed definition of “salary” to calculate social insurance contributions and the introduction of paternity leave.  Employers also have new obligations to their employees in the field of labour safety and hygiene, and in regards to female employees.  Further guidance has also been provided in respect to conducting labour discipline and poor performance terminations.

Decree No. 11 will also have a profound impact on businesses in Vietnam and expat mobility.  Some changes facilitate foreign workers coming to Vietnam, such as simplified paperwork for work permit applications, faster processing times and new work permit exemptions.  On the other hand, some changes may prevent foreigners from working in Vietnam, particularly those who cannot meet the new definition of an “expert” or “specialist” under the law.

We will explain the major changes to labour law that will impact businesses, and how to deal with these new changes.

Nguyen Thuy HangMs. Thuy Hang Nguyen, Partner, Ho Chi Minh City, Baker & McKenzie

Ms. Nguyen is a Partner in our Ho Chi Minh City Office, who is admitted to practice law in New York and Vietnam.  Since joining Baker & McKenzie in 2006, she has provided legal advice and assistance on a wide range of practice areas in various investment projects and has advised on transactional, corporate and regulatory issues in Vietnam, including employment and labor, merger & acquisitions, compliance, corporate and commercial.

Ms. Nguyen heads the Firm’s labor and employment law practice group in Vietnam and is part of the wider Asia Pacific and Global Employment Law Group of the Firm.  She advises on all types of employment and labor matters, in both contentious and non–contentious issues, but she particularly focuses on labor regulations compliance, employment aspects of major transactions and corporate restructurings, global migration and executive mobility, restrictive covenants, labor relations and unions, and labor dispute resolution.

Ms. Nguyen is the Chairwoman of HR/Labor Committee of American Chamber of Commerce, Ho Chi Minh City Chapter, and is a leading authority and frequent speaker on Vietnam employment and labor law in Vietnam and the region.

Ms. Nguyen holds a B.A. in International Law from the Diplomatic Academy of Vietnam, a LL.M. in International and Comparative Law from Southern Methodist University’s Dedman School of Law, and an Executive MBA from the University of Hawai’i at Manoa’s Shidler College of Business.
