Event Description

In a TPP-less world, what will happen with intellectual property standard-setting in Vietnam and ASEAN? Will the higher standards being adopted by Brunei, Malaysia, and Singapore in the absence of outright TPP obligations continue to impact attitudes about the importance of enhanced IP protection and enforcement in the region and incentivize other ASEAN member states to up their own game? Will Vietnam follow suite? If so, what are the motivations for pursuing stronger IP protection and enforcement? The speaker will review recent discussions and planned legislative developments in the IP space in ASEAN and address the concerns of IP stakeholders in a rapidly evolving environment.

Mr. Peter N. Fowler, Senior Counsel for Enforcement and Acting Regional IP Attaché for Southeast Asia, United States Patent and Trademark Office

Peter N. Fowler is a Senior Counsel for Enforcement in the Office of Policy and International Affairs at the United States Patent and Trademark Office (USPTO), and former Regional Intellectual Property Attaché for Southeast Asia, based in Bangkok, Thailand. As Regional IP Attaché, Mr. Fowler served as a resource for U.S. government personnel and national IP offices, and as coordinator of USPTO activities in the Southeast Asia region. Prior to his appointment from 2011-2016, as the Regional IP Attaché, he served as Senior Counsel for Enforcement, managing the USPTO Enforcement Team and working on a range of intellectual property enforcement policy issues and training and capacity-building programs. He previously held positions as the agency’s Chief of Staff, Senior Advisor to the Under Secretary and Director, and Acting Deputy Administrator for External Affairs on two separate occasions.

Mr. Fowler joined the USPTO in 1995, as an Attorney-Advisor in the Office of Legislative and International Affairs, working on domestic and international copyright issues, including the WIPO Internet Treaties and the Digital Millennium Copyright Act, and served as the facilitator of the Conference on Fair Use from 1995-1998. He has been a technical advisor to the Office of the United States Trade Representative on a number of trade agreements, including those with Australia, Bahrain, Malaysia, Oman, Singapore, Thailand, UAE, and Vietnam, as well as on the Anti-Counterfeiting Trade Agreement, and the Trans-Pacific Partnership Agreement. He is a recipient of three Department of Commerce Gold Medal Awards for distinguished performance and extraordinary contributions in support of the mission of the U.S. Department of Commerce.

Mr. Fowler is admitted to the practice of law in California, where he practiced copyright, trademark, and entertainment law for a decade with a boutique law firm in San Francisco, and before both the U.S. Court of Appeals for the Ninth Circuit and U.S. Court of Appeals for the Federal Circuit. He is an Advisory Board member of the Golden Gate University School of Law Intellectual Property Law Center and the San Francisco Silent Film Festival, and a member of the Regional Advisory Group for the United Nations Economic and Social Commission for Asia and the Pacific Region. He has taught as an Adjunct Associate Professor of Law at Golden Gate University School of Law, as an adjunct lecturer at the University of California Hastings College of the Law and the University of San Francisco College of Professional Studies, and as an adjunct visiting professor at Universidad Pontifícia Bolivariana in Medellín, Colombia. He has authored a number of law review and journal articles on topics including copyright, intellectual property and trade, immigration, adult adoption, and intellectual property protection and enforcement in ASEAN.

Mr. Fowler received his B.A. in Political Science from John Carroll University; an M.A. in Secondary Education from the University of Alabama; an M.A. in Political Science from Ball State University; and his J.D. from Golden Gate University School of Law, where he was a contributor to the Golden Gate University Law Review.
