Event Description

“Labor Sub-Leasing” (also known as “Labor outsourcing,” “Staff outsourcing,” “Staffing,” “Outsourcing,” “Outsourced staffing,” “Contract management,” and “Contract parking.”) is a new concept in Vietnam’s legal jargon, but not necessarily to the market. Companies have been using this service for a long time to find short term labour to cover for high customer demand or when regular staff are unavailable. The market demand is high and labor subleasing is becoming increasingly common in Vietnam. Companies seek to improve their competitiveness through flexible staffing arrangements. For example, companies can lower their average total staffing costs by hiring workers to cover peak periods only.  Lower staff costs can mean higher profit margins or greater ability to lower prices in a competitive market.

Meanwhile, the legislation (Decree No. 55) is new and strict, making it difficult for companies, both from service provider and service user sides, to maneuver. Since its implementation less than one year ago, the business community has constantly requested for revisions and updates. Partly in response to these requests, a draft amendment of Decree no. 55 has been recently circulated for comment.

NguyenThuyHangMs. Thuy Hang NGUYEN, Special Counsel, Baker & McKenzie (Vietnam) Ltd.Ms. Nguyen is admitted to practice law in New York and Vietnam.  Since joining Baker & McKenzie in 2006, she has been involved in a wide range of practice areas in various investment projects and advised on corporate and regulatory compliance issues in Vietnam, including employment and labor, foreign investment licensing, corporate and commercial, mergers and acquisitions, and related matters.  Regarding employment law practice, Ms. Nguyen coordinates the firm’s Labor and Employment Law Practice Group in Vietnam and is part of the wider Asia Pacific and Global Employment Law Group of the firm.  She has advised on all types of employment and labor matters, in both contentious and non – contentious issues, but she particularly focuses on labor regulations compliance, global migration and executive mobility, employment aspects of major corporate restructurings and transactions, restrictive covenants and trade secrets, and labor dispute resolution.
Ms. Nguyen holds a B.A. in International Law from the Diplomatic Academy of Vietnam, an LL.M. in International and Comparative Law from Southern Methodist University’s Dedman School of Law, and an Executive MBA from the University of Hawai’i at Manoa’s Shidler College of Business.

Hong NguyenMs. Hong Nguyen, Deputy General Director, HR2B Ho Chi Minh City
After graduation from University, Ms. Hong worked in the Hospitality industry for almost three years as customer services role. In 1996, she joined Merck & Co., a US pharmaceutical company, as Executive Assistant to General Manager. In 2000, she transferred to an HR role, in charge general HR for Vietnam. In 2003, she has moved to HR management level in various industries of Advertising and Retail. In November 2005, Ms. Hong joined HR2B as Branch Manager Hanoi and successfully set up the office and Search Team there.  In 2007, she returned to HCMC to lead and develop this larger Search Team. In July 2010, HR2B acquired Contracting service business from Navigos Group, and her role changed to Business Development Director. With more than 10 years in HR management,  her role is to develop and provide HR services to clients. As an active member of AmCham HR Committee, EuroCham, the Vietnam HR Group, and HR Association in Vietnam, Hong has developed and maintained a strong network in the HR and business community nationwide in Vietnam.

Hanh KT=1[1]Mr. Khuu Tan Hanh, Head of Human Resources, Wipro Unza Vietnam Ltd. With 18 years’ experience in human resources management and development, Mr. Hanh is a veteran HR practitioner. After university graduation, Mr. Hanh started his HRM career with Procter & Gamble Vietnam in compensation & benefits section in the period between 1996 and 2001. He has since progressed his career development with Coca-Cola Vietnam, La Vie (Nestle Waters Vietnam), and British American Tobacco Vietnam, as HR manager/ director roles, both at local and cluster levels, in various HR sub-areas including total rewards management, HR information system management, international assignment management, business partnering, HR shared services operations, and country HR head. In 2010, Mr. Hanh joined Wipro Unza Vietnam, a leading personal care products company, the manufacturer and marketer of popular brands such as Enchanteur and Romano. There he has contributed to build up the company’s employer brand into the “100 Vietnam Best Places to Work” list, out of 1,003 companies nominated by 9032 mid-career professionals via the recent Anphabe-sponsored survey conducted by AC Nielsen Vietnam in 2013.
