Event Description

We would like to invite you to the breakfast meeting themed “Risks in Terminating Problem Employees” hosted by AmCham on 31 October 2017.

Generally speaking, Vietnam’s labor law is very employee-friendly, especially on issues related to employment termination. Unlike the law of many other jurisdictions, Vietnamese law does not recognize the concept of “termination at will”. Employment termination must follow strict requirements on reasons and procedures, and the cases in which an employer can terminate its employees are fairly limited. However, in practice businesses often rely solely on their internal corporate policy or practices, or do not fully consider legal requirements in dealing with termination cases, exposing them to the major risk of having their termination decisions challenged by the impacted employees and found unlawful by Vietnamese courts.

To address the business community’s needs of basic knowledge and practical advice on this subject matter, we organize this event with the aim to provide a forum for employment lawyers to share their expertise in employment termination with businesses, allowing them to raise their concerns and seek legal recommendations.

At the event, a presentation on the Vietnamese legal framework regarding employment termination will be delivered by employment law experts from the Employment Practice Group of Baker McKenzie Vietnam, and followed up by a Q&A session.

Speakers

Sarah Galeski, Special Counsel, Baker & McKenzie (Vietnam) Ltd.

Ms. Sarah Galeski is a Special Counsel in the employment law group at Baker & McKenzie in Vietnam. Sarah has been a member of Baker & McKenzie’s employment team in Vietnam for four years, and prior to coming to Vietnam, acted as a litigator in Canada for four years, where her work involved many contentious employment matters.

Sarah has experience in a full range of employment law matters. She has expertise on contentious employment matters such as dismissals and the negotiation of separation agreements, as well as non-contentious matters such as the drafting of employment contracts, internal labour regulations, service agreements and consultancy agreements. Sarah also advises on employment issues in relation to global asset and share transactions.

Sarah regularly provides employment training to senior managers and presents at the local chambers of commerce on issues ranging from whistle-blower protection, to new legal developments, to employee dismissals.

Sarah is a graduate of McGill University (BA, International Development and Psychology, 2003) and studied law at the University of British Columbia (LLB, 2008). While attending law school, Sarah received the Davis & Company prize in Asian Law. Sarah is a member of the British Columbia Law Society.

Van Trung Khuat, Associate, Baker & McKenzie (Vietnam) Ltd.

Trung started working at Baker & McKenzie since April 2012. His practice covers labor and employment, and litigation. Regarding employment law practice, Trung has advised on all types of employment and labor matters, including contentious employment issues such as employment termination, labor disputes and court proceedings, as well as non-contentious employment matters such as regulatory advice, labor and employment due diligence, executive mobility, and employment aspects in global restructuring projects and M&A transactions.

Trung is a frequent speaker on labor and employment issues in Vietnam.

Trung earned an LL.B. from Hanoi Law University (2008), and an LL.M. from Vietnam National University (2013). He is a member of the International Bar Association in July 2017, member of Vietnam Lawyers’ Association and Hanoi Bar Association in 2012.

Thuy Hang Nguyen, Partner, Ho Chi Minh City, Baker & McKenzie

Ms. Nguyen is a Partner in our Ho Chi Minh City Office, who is admitted to practice law in New York and Vietnam.  Since joining Baker & McKenzie in 2006, she has provided legal advice and assistance on a wide range of practice areas in various investment projects and has advised on transactional, corporate and regulatory issues in Vietnam, including employment and labor, merger & acquisitions, compliance, corporate and commercial.

Ms. Nguyen heads the Firm’s labor and employment law practice group in Vietnam and is part of the wider Asia Pacific and Global Employment Law Group of the Firm.  She advises on all types of employment and labor matters, in both contentious and non–contentious issues, but she particularly focuses on labor regulations compliance, employment aspects of major transactions and corporate restructurings, global migration and executive mobility, restrictive covenants, labor relations and unions, and labor dispute resolution.

Ms. Nguyen is the Chairwoman of HR/Labor Committee of American Chamber of Commerce, Ho Chi Minh City Chapter, and is a leading authority and frequent speaker on Vietnam employment and labor law in Vietnam and the region.

Ms. Nguyen holds a B.A. in International Law from the Diplomatic Academy of Vietnam, a LL.M. in International and Comparative Law from Southern Methodist University’s Dedman School of Law, and an Executive MBA from the University of Hawai’i at Manoa’s Shidler College of Business.
