Legal Status of AmCham Vietnam

The American Chamber of Commerce in Vietnam (AmCham Vietnam) was re-established informally in HCM City on March 4, 1994  by American business representatives, about one month after U.S. President Clinton’s Memorandum and Announcement that lifted the U.S. embargo on trade with Vietnam on February 3, 1994.

U.S. Chamber of Commerce Member 2015In January 1996, AmCham Vietnam (HCM City) was approved as an Organization Member of the U.S. Chamber of Commerce, which represents 3,000,000 businesses, 2,800 state and local chambers, 830 business associations, and 117 American Chambers of Commerce in 103 countries. Only members of the Chamber of Commerce of the USA® may display the “U.S. Chamber of Commerce Member” websticker.

On January 22, 1998, the DECREE OF THE GOVERNMENT Promulgating the Regulations on the Establishment of Foreign Business Associations in Vietnam, Decree No. 08/1998/ND-CP, dated 22 January 1998, was issued.

On September 19, 1998, based on an application submitted by the Board of Governors, AmCham Vietnam was officially recognized by the receipt of a “License for the Establishment of a Foreign Business Association in Vietnam,” No.-02/GP/HHND/HCM from the People’s Committee of Ho Chi Minh City, having its headquarters in Ho Chi Minh City, and a branch in Hà Nội.  On September 17, 2003, an Extension of License was received, valid for a period of three years, based on Article 6 of Decree No. 08. On August 17, 2006, another License Extension was received, valid until September 19, 2009. On August 17, 2009, another License Extension was received, valid until September 19, 2012. On July 14, 2012 another License Extension was received, valid until September 19, 2015. And on July 8, 2015, we received our current license, valid until September 19, 2018. We expect that it will be continually renewed in the future. In addition, we have received license extensions for the AmCham branch in Hanoi, most recently in 2015, valid until 2018.

Logo of the American Chamber of Commerce in Vietnam

The United States Patent & Trademark Office issued a Certificate of Registration for the AmCham Logo to the American Chamber of Commerce in Vietnam on October 7, 2008. In accordance with the requirements in the certificate of registration, a “Combined Declaration of Use and Incontestability” was submitted via the “Trademark Electronic Application System (TEAS) on February 20, 2014. So the registration will remain in force for ten (10) years, from Oct 7, 2008 until Oct 7, 2018.
