Tax issues in Vietnam have been on the rise as the economy continues to grow and become more complex and the government seeks to meet their budgetary needs.  This event will introduce you to our new AmCham Tax Committee that has been formed to focus on the Chamber’s tax-related activities, which include keeping AmCham members abreast of tax issues and promoting the improvement of tax regulations in Vietnam.  This event will feature a presentation discussing the factors that are leading to an increase in tax-related issues and a session to discuss various current and emerging tax topics.

The AmCham Tax Committee will also be interested to hear about your tax-related concerns in order to help prioritize the Tax Committee’s initiatives, such as arranging future presentations and collaborating as a collective group in our tax policy advocacy efforts.  We ask that you please complete the survey that we will be distributing as part of the event.

Moderator

Mr. Fred Burke – Managing Partner – Baker & Mckenzie Vietnam.

Fred has been active in AmCham in Vietnam since it was first established in 1994. He served as a member of the Board of Governors from 1995 – 2003 and was Chairman in 1997. After a hiatus of four years, he was re-elected to the Board in December 2007.

He has been a leader of the Legal Committee since 2004, as Chairman and then Board Liaison, focusing on articulating the American business community’s issues to the Vietnamese and United States governments in the contexts of the World Trade Organization negotiations, the Vietnam Business Forum, and more recently in the implementation of Vietnam’s WTO commitments. He has helped to write many of the Chamber’s position papers, was one of the Chamber’s leaders in supporting the conclusion of the landmark 2001 Bilateral Trade Agreement, and he has represented the Chamber in numerous governmental and private sector briefings and seminars.

Before coming to Vietnam in 1991, he served as the Secretary and Member of the Board of the American Chamber of Commerce in Shanghai, China.

Fred is Managing Partner of Baker & Mckenzie Vietnam, with Practice Areas: Mergers and Acquisitions, Project Finance, Foreign Investment & Securities, Financial Services, Real Estate, Construction/Projects, Taxation, International Trade & WTO, International Employment, Intellectual Property & Technology Transfer and Dispute Resolution. Mr. Thanh Vinh Nguyen – Partner of Baker McKenzie Ho Chi Minh City Office

Thanh Vinh Nguyen is a Partner in the Baker McKenzie Ho Chi Minh City office, where he leads the Tax and Customs practice group in Vietnam. Mr. Nguyen’s practice areas include tax and customs, trade and general commercial matters. Prior to joining Baker McKenzie’s Ho Chi Minh City office in 2004, Mr. Nguyen practiced tax advisory work for two international accounting firms for eight years and worked in the compliance function of an international insurance company. An expert in tax planning and law, Mr. Nguyen has assisted clients with advice and structuring work as well as contentious appeals with the tax authorities. Mr. Nguyen is an award winning practitioner, recently recognized by the International Tax Review in the categories of: Indirect Tax Leader (2017) and Tax Controversy Leader (2017) as well as being ranked as a Leading Lawyer for Taxation in Legal 500 Asia Pacific (2017).

He has written a number of articles on Vietnamese tax issues and is co-author of the tax management portfolio Business Operations in Vietnam, published by Bloomberg BNA. Recently, Mr. Nguyen co-authored the Vietnam chapter of Inward Investment and International Taxation Review – 8th Edition.

Mr. Nguyen holds a Bachelor of Arts degree in English from the University of Ho Chi Minh City and an LL.B from the University of Law of Ho Chi Minh City.

Mr. Đoàn Diệu Minh – Tax Manager – Intel Products Vietnam

Minh currently is the Senior Tax Manager of Intel Corporation, responsible for Vietnam, Australia and New Zealand. Minh has more than 6 years of experience working at PwC Vietnam and KPMG Vietnam and an equivalent number of years with Intel Corporation. During the period working with PwC Vietnam and KPMG Vietnam, he provided tax compliance, tax consultancy and Tax Due Diligent services to a wide range of industries including manufacturing, service, oil & gas, trading, hi-tech, and etc. At Intel Corporation, Minh focused on M&A, tax compliance and tax planning and restructuring. He led many critical projects to drive the tax efficiency for Intel businesses in Vietnam and in the APAC region.

Minh is currently the Chair of AmCham Tax Committee.

Minh holds a Bachelor degree on Foreign Economic Relations at the Foreign Trade University in Ho Chi Minh City and a MBA degree at Columbia Southern University in USA.

Panelists

Mr. Nguyen Thanh Trung – Partner of PwC Vietnam

Trung is a Partner in the Tax and Legal Services practice of PwC Vietnam, with more than 18 years of professional experience in tax consulting. Trung provides taxation services to a wide range of clients, including multinational and regional groups with operations in Vietnam, as well as some of the largest Vietnamese private and state owned companies.

Trung has a regular dialogue with the Vietnamese taxation authorities, both at provincial level and with the General Department of Tax and the Ministry of Finance in Ha Noi, during which he often provides input on proposed new tax regulations and feedback on existing laws.

He specializes in tax audits and dispute resolution and has assisted a large number of clients work with various authorities and government agencies to successfully address issues they are facing.

Trung has worked with some of the largest foreign investors into Vietnam, both green field investments and acquisitions, with a particular focus in the real estate and consumer & industrial goods sectors.

Trung holds a Bachelor’s Degree in Economics, and is a fellow of the UK Association of Chartered Certified Accountants (ACCA) and a Vietnamese CPA. He also holds a tax agent practising certificate, and is an active member of the Vietnam Tax Consultants Association.

Mr. Dong Hoang Nam – Legal Director of Unilever Vietnam

Nam is Legal Director of Unilever Vietnam and has over 18 years practicing in legal area, investment, trade, corporate, tax, labour, anti-trust, anti-Bribery/corruption, privacy, litigation. Nam started the first job with Department of Justice, and then worked for a number of law firms before took role of corporate counsel. With a position of head of legal and compliance, Nam supervised and managed all legal matters of the company by providing legal strategic advice and direction on wide range of matters related to manufacturing, investment, sale, marketing, customer services, tax, labour, litigation, governmental inspection to all divisions and departments, and employees of the company.

Nam spent time in Australia to get Master of Law Degree in 2007 and then back school in 2016 get a MBA of a Canadian University. Nam is a qualified lawyer of HCMC Bar, Executive Board Member of Ho Chi Minh City In House Counsel Club, member of some committees under AmCham.
