Ministry of Justice Statement at Vietnam Business Forum re amended Law on Lawyers, Dec 3, 2012

At the Dec 3, 2012 Vietnam Business Forum, in response to AmCham’s request for clarification, Vice Minister Le Hong Son confirmed clearly that Vietnamese lawyers working at international law firms may continue to engage in the full range of consultancy services allowed under Article 28 of the Law on Lawyers, including drafting commercial contracts and business charters. This formal statement, made on the record in front of 300+ government leaders, official development assistance (ODA) donors, foreign government representatives, heads of chambers of commerce and the press, will be recorded in the minutes of the Forum and posted to the VBF’s website.

AmCham had requested in a letter to the Minister of Justice and others, Nov 30, 2012, that

“We urge the Government of Vietnam to officially confirm that Vietnamese lawyers can continue to write commercial contracts and business charters, even if they work for foreign firms.

Vietnam Business Forum (VBF)

For over a decade, AmCham has been a strong supporter of the Vietnam Business Forum, which was financed and managed by the International Finance Corporation (IFC), a member of the World Bank Group.

In February 2012, the IFC officially transferred the coordination function of the VBF Secretariat to a consortium of 14 foreign and Vietnamese business associations, led by AmCham, EuroCham and VCCI. The Consortium established a New VBF Secretariat to coordination all day – to – day activities of the Forum. The Management structure of the VBF Consortium consists of a Management Board with seven representatives (AmCham, EuroCham, VCCI, JBAV, KorCham, IFC, HYBA). This year’s co-chairmen of the Management Board are VCCI and EuroCham.

AmCham is working to make the forum more effective at addressing the advocacy needs of our members. You are invited to participate and have your issues heard. Become involved in a VBF working group.
