Hiện nay, cùng với sự phát triển của nền kinh tế thị trường thì việc xảy ra các tranh chấp là điều không thể tránh khỏi. Trong đó, việc giải quyết các tranh chấp thương mại thường mất nhiều thời gian và chi phí. Tuy nhiên, khi doanh nghiệp thắng kiện thì không đồng nghĩa với việc Cơ quan thi hành án dân sự sẽ tự động đưa bản án, phán quyết có hiệu lực pháp luật ra thi hành (ngoại trừ các trường hợp thi hành án chủ động). Trên cơ sở bản án của Tòa, phán quyết của Trọng tài, doanh nghiệp cần phải có đơn yêu cầu thi hành án dân sự. Bởi lẽ, giai đoạn xét xử và giai đoạn thi hành án là hai giai đoạn riêng rẽ, độc lập, mỗi giai đoạn có những nhiệm vụ, quy trình riêng. Vấn đề đặt ra là, mất bao lâu để doanh nghiệp thắng kiện được thi hành án (lấy được tiền/thu hồi được tài sản)? Chi phí thi hành án là bao nhiêu? Những vướng mắc doanh nghiệp thường gặp trong thi hành án kinh doanh, thương mại là gì? Thực tiễn đã có rất nhiều doanh nghiêp thắng kiện nhưng quá trình thi hành bị kéo dài, tồn đọng từ năm sang năm khác vẫn chưa được thi hành xong. Với chủ đề: “Thi hành án kinh doanh, thương mại – Vướng mắc và giải pháp” chúng tôi sẽ cung cấp cho doanh nghiệp một số kiến thức pháp luật trong lĩnh vực thi hành án kinh doanh, thương mại và giải pháp để doanh nghiệp có thể tác động kịp thời đến Cơ quan thi hành án dân sự, hạn chế tối đa việc thi hành án bị trì trệ, kéo dài. |

With the astoundingly rapid development of the market economy in Vietnam, commercial disputes are inevitable. Assuming your side has a strong case, you can often expect a favorable judgment. Nevertheless, it is well-known that the resolution of commercial disputes often results in a significant investment in time and money for any business. In addition, contrary to common thinking, the actual winning of a lawsuit is only one step in the recovery process. It does not mean that the Civil Judgment Enforcement Authority will automatically enforce a legally effective judgment or arbitral award (except when the Civil Judgment Enforcement Authority decides to enforce judgments on its own initiative). Should a favorable judgment or arbitral award be obtained, enterprises are still required to submit written requests for civil judgment enforcement, because the trial stage and the judgment enforcement stage are two separate and independent phases of litigation. Each stage has its own functions and processes. How long does it take for an enterprise that wins a case to have the judgment enforced (receiving money/recovering assets)? How much does judgment enforcement cost? What are the common obstacles faced by enterprises looking to enforce business and commercial judgments? The fact is that there are numerous enterprises that have won lawsuits, but fail to complete the enforcement process which is prolonged and accumulates from year to year. In this important Seminar entitled: “Business and commercial judgment enforcement – Obstacles and solutions”, we will arm enterprises with the necessary legal knowledge to navigate the field of business and commercial judgment enforcement. We will also offer strategies to assist enterprises in their interactions with the Civil Judgment Enforcement Authority in order to minimize delay in the judgment enforcement process. |

She has extensive experience in review of coercive enforcement of judgments, the process of auctioning assets for debt recovery, and the law involving settlements of complaints and denunciations concerning civil judgment enforcement. Trước khi gia nhập LeTran, Candy có 08 năm công tác kiểm sát thi hành án dân sự; đồng thời, kiêm nhiệm công tác kiểm sát việc giải quyết các vụ án dân sự – hôn nhân gia đình tại Viện kiểm sát Nhân dân Thành phố Hồ Chí Minh và Viện Kiểm sát Nhân dân Quận Tân Bình, Thành phố Hồ Chí Minh. Cô ấy có bề dày kinh nghiệm trong công tác kiểm sát cưỡng chế thi hành án; kiểm sát quá trình bán đấu giá tài sản để thu hồi nợ; kiểm sát việc tuân theo pháp luật trong việc giải quyết khiếu nại, tố cáo về thi hành án dân sự.
